TERMS AND CONDITIONS


Our promises

We will permit you to access, use, and interact with our platform subject to these Terms and Conditions (T&Cs).

We will:

exercise reasonable care in building and compiling our platform;

use reasonable efforts to make our platform available to you at all times, subject to relevant provisions of this T&C; and

take the reasonable steps set out in our policy to secure any personal data and financial information you give to us.

The User agrees that:

The costs and charges quoted on our platform in respect of our services are non-negotiable and subject to review, such review will be communicated to you prior taking effect.

Post-repair warranty cover for devices repaired through our platform is subject to the terms and conditions of the Service Centre of the device’s Original Equipment Manufacturer.

Warranty terms and warranty approval are exclusively the responsibility of the Service Centre of the Original Equipment Manufacturer and not ours.

All SIM cards, Memory/SD cards and all similar detachable accessories to any device must be removed by user before submitting device for repairs.

In many cases, we may require the password/pin to your device to allow repair operatives have access to the device for the repair process.

We will not be liable for any accessories left in or on the device handed to any Service Centre through us for repairs.

Users must back up the data and information on any device before submitting the device for repairs.

We will not be responsible for any data and or information lost during any repair process.

Users that report wrong faults affecting the device will be informed of the actual fault and attendant costs. Where the user declines to continue with the repairs, the Service Centre may charge handling or labour cost for their diagnosis of the fault affecting the device. Users will be informed of the handling or labour costs and thereafter be refunded of the balance.

T&Cs for Subscribers to Device Protection Plans

McDorsey will be collecting the following information from Subscribers to Device Protection Plans-
Subscriber’s First Name
Subscriber’s Last Name
Subscriber’s Email Address
Subscriber’s Contact Number
Subscriber’s address for pickup and delivery
Device International Mobile Equipment Identity (IMEI) number & Serial Number
Device Market Value
Device Make and Model
Device Front Image with IMEI & Video
Virtual National Identification Number (VNIN)

The device protection plan is only open to individuals who are 18 years and above.

A customer can subscribe to a daily, weekly, monthly, or yearly plan as soon as each of these plans are available on our platform.

McDorsey customers are eligible for doorstep, pick-up and drop-up facilities.

McDorsey Customers can subscribe to the Offer via www.McDorsey .com.

McDorsey Subscribers can raise multiple claims under the plan subscribed to, subject to the consolidated value of the claims not exceeding the capped benefit value under the plan. Where the claims value exceeds the capped benefit value, McDorsey subscriber has to pay the balance.

Upon completing all the steps for activation, the benefits of the pack shall continue as long as the customer continues to make payment of subscription fee. The subscription fee shall be chargeable on a daily, weekly, monthly, or yearly basis, depending on the plan selected by a customer. Provided that daily and weekly subscribers can still pay their subscriptions as a bulk fee within the respective month.

Monthly payments for a monthly plan have to be paid within each month, else the plan will become void on the last day of the month. Where daily and weekly subscribers opt to make bulk payment in a month, failure to make such bulk payment within each month will also render the plan void.

The payment for the renewal of the subscription to the offer is recurring and automatic. However, you may cancel the payment before the date for the renewal. Please note that any payment not made on the due date will lead to cancellation of the service and a customer will be ineligible to raise any claim or benefits. Where the subscription is renewed, the customer shall receive notification of the renewal via SMS.

Where the Subscriber claims all the benefit value and intends to buy another device protection plan for the same device, the McDorsey subscriber can buy the device protection plan for the same device after settling the premium for already purchased plan, if there is any due.

In case subscriber utilizes 100% of the benefit value before completing the monthly premiums for the purchased plan, the subscriber has to complete the balance premium. (E.g. If a customer buys a protection for a coverage up to 100,000 Naira when there is a damage costing 105,000 Naira, customer has to pay 5,000 Naira + Premium balance to avail the claim).

Where the Customer fails to make this payment, the Customer will be unsubscribed from the service and will be ineligible to raise any claim/benefits/new purchase of our service.

McDorsey Subscribers cannot buy a device protection plan for their electronic devices without valid a IMEI and Serial Number.

For claims raised within 60 days of purchase of device protection plan, customer is liable for pickup and delivery charge.

The Customer having complied with the requirements of McDorsey and/or their Insurer for the purposes of processing the claim, the following are required from the customer:

Damaged device images - Front image of the device with IMEI reflecting on screen and Back image
Date of damage/incident
Damage description (Proper damage description i.e. how your device got damaged)
Virtual National Identification Number (VNIN)
All the documents and information will be verified by McDorsey /Insurer in the onboarding Process.

McDorsey Customer will get their device protection plan activated within 72 Hours after verification of the details of the device.

No event/incident is covered until the device protection plan is activated.

In case the details provided by McDorsey customer is not clear, McDorsey will notify the subscriber to furnish correct details and if it is found to be fake, the device protection plan will be cancelled for that device but the subscriber has the sole option of onboarding another device with genuine details.

T&C for Devices Covered by Device Protection Plans

McDorsey Customers with new and old devices are eligible.

Customer devices with accidental and liquid damage will be covered.

There is no device age restriction on insurance eligibility on devices. It covers both new and old devices from all brands officially operating in Nigeria.

Subscribers will be required to revalidate the details and condition of the device after 12 months. The revalidation involves uploading the current images and video of the device at the required time of the revalidation.

Device Protection Plan Purchase And Claim Process

Device Protection Plan can be purchased through www.McDorsey .com

Visit the website and signup. Login to the platform after signing up.

Select “Device Care” option.

Choose the best plan that suits you and provide the details about the device brand, model, and purchase value of the device.

Read and agree to the terms and conditions.

Make the payment through available options on the platform. Please note that delivery of your chosen services involves multiple service providers whose business models are unable to accommodate any cancellations or refunds after purchases and payments are made. We encourage you to please read the terms and conditions before proceeding as refunds will not be possible subsequent to any purchases made by you. However, any payment made on our platform can be transferred to onboard another device.

Notification of purchase will be sent to you by e-mail and SMS.

Then click on “Onboard Device” and fill the required details and upload the images and video of the device in a perfect condition.

(NOTE: Kindly dial *#06# to retrieve the device IMEI and snap the image of your device from another device. Share device image with IMEI reflecting on the screen [NO SCREENSHOTS ALLOWED]). The customer hereby agrees to share front image of their device with IMEI number on screen (NO SCREENSHOTS ALLOWED).

Click on Submit and wait for approval of device condition (Max. 72 hours for the approval).

Notification will be sent to you by e-mail and SMS as soon as your protection plan is approved.

Where the device is damaged accidentally, click on “CLAIMS” under “Device care” and fill the details of the damage and how the damage occurred, including images and video of the damage.

McDorsey will verify and notify you by SMS and e-mail.

Where the repair cost is higher than the coverage value, the balance payment will be required to be paid by you.

Device pickup will be initiated, the device will be repaired in an authorized service center and delivered back to you afterward.

Where a device is not repairable, device replacement will be initiated and the excess amount, if any, required for the replacement will be paid by customer.

Where a device is not repairable and same device model is not available for the purpose of replacement, the customer will have the option to upgrade the device to another model. Any excess amount required for such replacement will be borne by the customer.

Claims cannot be made for devices with removed or altered serial and IMEI numbers or cloned devices, or false information supplied by the Customer, and devices willfully, deliberately, maliciously, carelessly or negligently damaged.
Claims cannot be made for damages occasioned by or attributed to vermin, insects, mildew, wear or other deterioration or any process of repairing, restoring, or renovating.
Claims cannot be made for damages resulting from, related to, or attributed to any nuclear fuel or waste, acts of terrorism, war, foreign enemy, invasion, hostilities, mutiny, civil commotion, military uprising, insurrection, rebellion, revolution, riot, strike, or any act calculated or directed to bring about public disorder, or to further any political aim.
Theft or loss of a device is not covered under the device protection plans.

Once a device is replaced, the existing plan for the old device will terminate and can no longer be used for the new device. However, a Customer can buy a new plan for the new device.

McDorsey has the right to reject the claim if the damages/faults to the device are found not to be genuine or malpractice is detected to have happened.

McDorsey reserves the right to review the prices of the device protection plans. Such review will be communicated to customers.

 

Exclusions and limitations

We do not represent or warrant that access to our platform, or any part of it will be uninterrupted, reliable, or fault-free.

We do not represent or warrant to you that our platform or any of its contents will be accurate or complete at all times.

All incentives on our platform are provided in conjunction with third-party partners. We will do our utmost best to ensure that promised incentives are fulfilled, but we do not represent or warrant that there will be no failure in providing an incentive or that the incentives will be provided at a certain time or to a certain extent. You agree that we will bear no responsibility or liability whatsoever for failure or delay in receiving any incentives.

We do not represent or warrant that:

any services (whether or not provided by us) will be provided with due care and skill, except as expressed by us in these terms and conditions; or

any service (whether or not provided by us) will be fit for any purpose, other than as expressed by us in these terms and conditions.

To the extent permitted by law, we exclude all liability (whether arising in contract, tort or otherwise) which may arise as a result of:

any technical, factual, textual or typographical inaccuracies, errors or omissions on or relating to our platform or any information on our platform;

the unavailability of our platform or services (or any part of it) at any time;

any delay in providing, or failure to provide or make available, services or any negligent (except willful) provision of services; or

any misrepresentation on or relating to our platform or the services (other than a fraudulent misrepresentation made by us).

You agree that each of these limitations is reasonable having regard to the nature of our platform and in particular given that when you engage the services of a Service Centre through our platform you will enter into a separate contract with the Service Centre in each case.

None of the above exclusions shall affect any statutory rights which are not capable of being excluded. However, in such case, our obligation and liability, where permitted by law, will be limited to the re-supply of our services through our platform or, in any case, limited to the amount paid by you for such service.

Each of the above exclusions or limitations shall be construed as a separate, and severable, provision of these terms and conditions.

Links to other apps

Certain links, including hypertext links, on our platform will take you outside our platform. Links are provided for your convenience and inclusion of any link does not imply endorsement or approval by us of the linked app, its operator or its content. We are not responsible for the content of any app outside our platform.

Termination

We may terminate your access to our platform immediately if you are in material breach of any of these terms and conditions and any other applicable and relevant rules, regulations, and laws guiding our relationship with you, and in particular upon any failure by you to pay any fees and charges incurred by you in accordance with these terms and conditions.

Restriction on Usage

You agree that you will use our platform only for the purposes for which it was created and that you shall not exploit our platform or any of its contents for any commercial purpose.

You shall not, attempt to, nor encourage or assist any third party to, directly or indirectly, modify, reproduce, reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code or underlying structure, ideas or algorithms of McDorsey or any part thereof.

General

Third party rights

Where in these terms, representations and warranties are made to us and to Service Centers through our platform by you, or you implicitly acknowledge and agree that such representations and warranties are intended to grant rights to, and operate for our benefits and the Service Centers, we and the Service Centers may rely upon and enforce such representations and warranties against you.

Variations

We reserve the right at any time without notice to you to revise the content of our platform (including the services offered by us) and these terms and conditions. Any changes to these terms and conditions will be posted on our platform and by continuing to use our platform following any such change, you signify that you agree to be bound by the revised terms and conditions of use.

Credit card security and registration

We work with level 1 Payment Card Industry Data Security Standard certified provider ensuring we have the highest level of certification for our transactions. We do not store any card details on our platform.

If you discover any unauthorised charges on your credit or debit card through our platform in circumstances where you did not agree to nor authorize such charges (provided you have not, through failure to take reasonable care, allowed an unauthorised person to gain access to your card details, purchaser ID or password), the Service Centers are required to refund to you the money they receive provided that: (a) you inform your credit or debit card company and us of the unauthorised purchase as soon as you discover it; and (b) you co- operate with your credit or debit card company, the Service Center, us and, if necessary, the police in relation to the unauthorised use.

Taxes

We have made every effort to clearly state whether the quoted prices for services available through our platform include any relevant tax or duty or otherwise. Where in any case it is not clear, please note that before you make an order, you may be required to bear a tax or duties liability (for example, value added tax) imposed by the Service Center or by operation of law in addition to the cost of our service.

The use of your information

You agree that we may collect, store, and use information about you in accordance with our privacy policy. You acknowledge and agree to be bound by the terms of our privacy policy.
Copyright

All rights in the content, design, text, graphics and any other proprietary materials on our platform and the selection or arrangement thereof reside in us or our third-party partners. We grant you permission to electronically copy and print in hard copy reasonable portions of our platform solely in connection with the usage of services through our platform. Any other use of materials on our platform (including reproduction for purpose other than those noted above and any alternation, modification, distribution or republication) without our prior written permission is strictly prohibited.

Trademarks

We are the proprietor of the McDorsey trademark in the United Kingdom, Nigeria and other countries where our service is deployed. All other marks, product names and company names or logos used on our platform are our property or that of their respective owners. No permission is given by us in respect of the use of any such trademarks, get-up, product names, company names, logos or titles and such use may constitute an infringement of the holder's rights.

Access

We reserve the right in our sole discretion to deny users access to our platform or any part of our platform without notice and to decline to provide the service to any user that is in breach of these terms and conditions of use.

Events beyond our control

We shall not be liable to you for any breach of these terms and conditions of use or any failure to provide or delay in providing our services through our platform resulting from any event or circumstance beyond our reasonable control including, without limitation, third-party dependencies, strikes, lock-outs, sit at home orders, epidemic, pandemic, adverse governmental action or regulation, and other individual disputes, breakdown of systems or network access, fire, explosion, or accident.

Applicable law and jurisdiction

These terms and conditions (and any dispute, controversy, proceedings or claim of whatever nature arising out of or in any way relating to them or their formation) shall be governed by and interpreted in accordance with either the Laws of the United Kingdom or Nigeria (subject to the jurisdiction of the user) and, for these purposes, the parties irrevocably submit to mediation in accordance with the laws, rules and procedures governing mediation in either jurisdiction.

Unenforceability

The enforceability or otherwise of any provisions of these terms and conditions shall not affect the enforceability of the rest of these terms and conditions.
